Privacy Policy

PINCH, LLC and its affiliates ("PINCH" or "we", "us", or the "Company") respect your privacy and are committed to protecting it through compliance with this Privacy Policy (“Policy”). This Policy explains how we collect, use, share, and protect your Personal Information, which is information that relates to you as an individually identifiable person, such as your name, e-mail address, and mobile number.  The Policy explains:  â€‹

How we may share that information and for what purposes;

How we protect your information; and

How to contact us with questions about this Privacy Policy.

This Policy applies only to the PINCH mobile applications, including the mobile application for service requesters and the mobile application for service providers (collectively the "App") and (b) information that we collect on our website, www.pinchjob.com (the “Site”).  Our services, platform, Site, and App are referred to collectively as the “PINCH Platform.”  Please read this policy carefully.  If you do not want us to handle your Personal Information in the manner described herein, please do not use the PINCH Platform.  This policy may change from time to time and your continued use of the PINCH Platform after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.  This policy DOES NOT apply to information that we collect offline or on any other Company apps or websites, including websites you may access through this App; or to information that you provide to or is collected by third parties.

1. INFORMATION WE COLLECT
a. Personal Information You Give Us

i. We collect information that you voluntarily share with us through the PINCH Platform.

ii. If you are using the PINCH Platform to request services, or contact PINCH or its third-party service providers, you may give us:​

Contact information and identifiers, such as your name, physical address, telephone number, and email address;

Log-in information and identifiers, including your PINCH Platform username and password;

Information about your home, dwelling, and/or property, such as square footage, number of bedrooms, zip code or postal code where your home, dwelling, and/or property is located, acreage, and instructions for services;

Billing information, such as credit or debit card number, expiration date, and security code and/or information regarding other methods of payment and the PINCH Platform itself; and

Ratings and reviews of the service providers you engage through the PINCH Platform.  

iii. If you participate on the PINCH Platform as a service professional, or contact PINCH or its third-party service providers, you may give us:

Contact information and identifiers, such as your name, email address, mailing address, and phone number; 1

Log-in information and identifiers, including your PINCH Platform username and password;

Application information, if requesting consideration to participate as a service provider through the PINCH Platform, such as your experience, skills, eligibility to work, and availability;

Photographs of yourself; and

Social Security number for background check

 

2. INFORMATION WE COLLECT THROUGH TECHNOLOGY
a. We collect information through technology to enhance our ability to serve you. When you access and use the PINCH Platform, or contact PINCH or its third-party service providers, PINCH and, in some cases, our third-party service providers collect information about you or how you interact with the PINCH Platform, such as:

i. Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including location data, communication data, and the resources that you access and use on or through the App;

ii. Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier (IP address), operating system, browser type, mobile network information, and the device’s telephone number;

iii. Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device, to the extent necessary for use of the App; and

iv. Location Information. This App collects real-time information about the location of your device, including the use of Global Positioning System (GPS) information provided.

3. INFORMATION COLLECTION AND TRACKING TECHNOLOGIES
a.  The technologies we use for automatic information collection may include:

i.  Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our App.

b. Web Beacons. Pages of the App and Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit PINCH, for example, to count users who have visited those pages and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

4.  THIRD-PARTY COLLECTION
a.  Information Provided About You

i.  Background Checks. PINCH uses third parties to conduct background checks on service providers.  Those third parties share the results of the background check with PINCH;

​ii. Ratings and Reviews. If you are using the PINCH Platform as a service provider, we may receive information about you in the form of ratings and reviews from requesters who engaged your services through the PINCH Platform; and

iii. Messages. If you send a message to a service provider or service requester in the App, PINCH collects and stores the message data, including the date, time, and content of the messages.

b. Information You Provide to a Third Party

i. The PINCH Platform includes links from the PINCH Platform to sites or applications operated by third parties ("Third-Party Sites") and plug-ins (such as Twitter buttons) from Third-Party Sites;

ii. Background Checks.  Service providers may be directed to a Third-Party Site to conduct a background check. The Third-Party Site may ask the service provider for identifying information to conduct the background check.​

The information third parties collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

5.  HOW WE USE THE PERSONAL INFORMATION WE COLLECT
a. PINCH does not sell any user data submitted to and housed within the PINCH Platform

b. We use information that we collect about you or that you provide to us, including any personal information,  to serve our customers, consider applicants, market and promote our services, conduct quality assessments, prevent fraud on the PINCH Platform, ensure and improve security on the PINCH Platform, and improve your overall experience using the PINCH Platform. Such uses include, but are not limited to:

i. Scheduling, rescheduling, and cancelling services;

ii. Rating and reviewing service providers;

iii. Providing public profiles of service providers;

iv. Addressing service complaints;

v. Communicating with you by email, telephone, or text message, in accordance with your wishes;

vi. To facilitate communications between Customers and Providers for service request;

vii. Managing payments for services;

viii. Considering whether to engage service providers on the PINCH Platform;

ix. Troubleshooting technical problems on the PINCH Platform;

x. Conducting research and analysis to enhance the user experience;

xi. Contacting you with regard to your use of the PINCH Platform and, in our discretion, changes to the PINCH Platform and/or the PINCH Platform policies; and/or

xii. To protect the rights, property, or safety of PINCH, our users, or others, and to report suspected criminal acts.

6. DISCLOSURE OF YOUR INFORMATION 
a. We may disclose aggregated information about our users and information that does not identify any individual or device, without restriction.

b. We may disclose personal information that we collect or you provide:

i. To Providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;

ii. To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of PINCH’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by PINCH about our App users is among the assets transferred;

iii. To fulfill the purpose for which you provide it (i.e., provision of services);

iv. For any other purpose disclosed by us when you provide the information;

v. With your consent;

​vi. To comply with any court order, law, or legal process, including to respond to any government or regulatory request; and/or

vii. To enforce our rights arising from any contracts entered into between you and us, including the Terms and Conditions.

c. Service Provider Profiles, Service Instructions by Requesters, and Ratings and Reviews by Requesters:

i. We may display profiles of the service providers, which may include the service professional’s name, and ratings and reviews about the service provider provided by their customers. The service professional’s profile may be visible to all users of the PINCH Platform;

ii. If you provide a rating or review about a service professional, we may post your first name, the initial of your last name, and the name of your neighborhood along with your rating or review on the service professional’s profile on the PINCH Platform; and

iii. In addition, service providers may use your ratings and reviews, as well as this personal information about you, in their own marketing materials.

d. Legal Advice.  We may disclose your Personal Information to an attorney in the process of obtaining legal advice.

e. Banks and Credit Card Companies.  We may disclose your Personal Information to banks and credit card companies in the process of investigating payment fraud and/or responding to disputed charges.

7. DATA SECURITY
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.  All information you provide to us is stored on our secure servers behind firewalls.  â€‹We do not store credit card information on our servers, and we use TLS encryption to protect your credit card information when it is transferred to our third-party payment processor, Stripe.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.  

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

 

8. YOUR CHOICES ABOUT OUR COLLECTION, USE, AND DISCLOSURE OF YOUR INFORMATION
We strive to provide you with choices regarding the personal information you provide to us. For instance, you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.  You may also choose whether or not to allow the App to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the App may become inaccessible or not function properly.  You may contact PINCH to update, correct, or delete your Personal Information. You may also update, correct, and delete some of your Personal Information through your account on the PINCH Platform.  You acknowledge that the deletion or removal of personal information may inhibit use of the App.

9. CHANGES TO THE PRIVACY POLICY
We may update our privacy policy from time to time. If we make material changes to how we treat your personal information, we will post the new privacy policy on this page and through other preferred means of communication, such as email or text message.  You are responsible for ensuring we have an up-to-date active and deliverable email address and phone number for you and for periodically visiting this privacy policy to check for any changes.  You may contact PINCH support for questions regarding this Policy.

1 Although users can submit credit card or other payment card information to pay for a service through the PINCH Platform, PINCH does not receive this information itself. Payment card information is transmitted directly to a third-party payment card processor, Stripe, through an internet connection secured by industry-standard encryption technology. Stripe then communicates to PINCH whether your payment has cleared but does not provide payment card information to PINCH.
